Some details of the suspension of the competition creditors in Uruguayan law
Abstract
The purpose of this paper is to offer constructive criticism of the current regime of the suspensión of bankruptcy proceedings in Uruguay, regulated by Law No. 18,387 (Uruguayan Insolvency Act, 2008). Taken almost literally from the Spanish Proposed Draft of Insolvency Act (SPDIA, 1996), which never saw the light as it claimed to be, this regulation has been largely superseded by the final wording of the current Spanish Insolvency Act 22/2003 of July 9th (SIA). However, for some reason that we ignore, our legislator has chosen to maintain its adherence to the SPDIA, rather than take advantage of the technical improvements introduced by the drafters of the SIA.
