Teoría del derecho y filosofía moral

Resumen

El objeto de este trabajo es plantear la hipótesis de que en el estado actual de la teoría jurídica, en función de los presupuestos metaéticos que, de modo explícito o implícito, integran cualquier concepción interesante sobre el derecho, la filosofía jurídica puede ser concebida como (una parte de la) filosofía moral. La hipótesis planteada surge a partir de dos preguntas que es pertinente formular a todos los teóricos del derecho: 1) ¿Hay una moral objetiva? 2) ¿Cómo incide la respuesta a la preguntar anterior en los modos conceptuales y normativos  a través de los cuales es posible dar cuenta del derecho como una práctica social?
