Civil servant disconnection in the central public administration. Ineptitude as a destitution reason analysis

Abstract

The present work focuses on the study of the ineptitud as a reason for destitution of public servants in Uruguay, included in the article 82 of Law 19.121, dictated on august 20th of 2013, that is denominated as “Civil Servant of Central Public Administration Status. It explained the doctrinal thought witch had refered to this reason and it started from an Administrative Disput Court sentence, analysis on demands of nullity against the State, with the finality of investigate about the ineptitude concept' scope received by the jurisprudence and relieve the different facts witch had been accepted to configurated this reason of destitution. That’s allows us to analysis the mentioned legal article scope. This work is insert on a more extensive topic, such as the public servant administrative responsability, and, the present announcement is the perfect opportunity to explore a topic that, besides represent a low percentage within the total volume of the sumarial procediments, it maintains interest for the law operator.
