Who’s Afraid of Literature?: The Empathic Training of the Judge, a Reading from Martha Nussbaum

This paper will explore some of the tensions between literature and law. The title is not arbitrary; it seeks to provoke thought and challenge the notion of literature as mere entertainment. The relationship between literature and law can be traced back to ancient Greece. Poetry, and especially theater, shaped and reflected the understanding of law and justice as the path to a good life. In our case, the challenge lies in demonstrating how the conjunction of literature and law can strengthen democracy by empathetically understanding social reality and people’s needs.
Our starting point is Martha Nussbaum’s interpretation of Poetic Justice (1997). This work is key to understanding, from a philosophical perspective, the contribution that literature offers to law through the selection of novels as a resource to promote poetic justice. Within the framework of law in literature, Nussbaum’s perspective contributes to an education of emotions that fosters empathy. Literature, by capturing the attention of judges, will train them to be judges who, without losing sight of legal reasoning, improve their empathetic capacity to understand complex situations and reach a fair solution.
