An Approaching the New Sexual Crimes Described by Law N° 19,580 (Law on Gender-Based Violence Against Women)

The aim of this paper is that of approaching the new statutory offences relating to sexual crimes created by Law Nº 19,580, within the Uruguayan legislation. With that purpose, it first provides a socio-legal framework which conceptualises the phenomenon of Gender-based Violence, and the Gender Perspective as well as its relationship with the law. Then, there is an analysis of the new criminal regulations trying to incorporate the Gender Perspective, their relationship with the existing ones, and the interpretative problems they pose, based on the conventional dogmatic categories of the Theory of Crime, drawing not only on the domestic and foreign doctrine but also on the comparative law.
